The Mabo Decision

It would not be easy to persuade the High Court of Australia to reverse the two century old assumption that any pre-existing land rights of indigenous people were simply not an issue.

So how could a reversal be achieved without questioning the very basis on which Britain acquired sovereignty of this country? And how could it be achieved without throwing into question two centuries of government land grants?

Justice Brennan delivered what is regarded as the 'lead judgment' in the Mabo case; and he made it clear that the court was not free to adopt a principle in the interests of justice, if to do so would "fracture the skeleton of principle which gives the body of our law its shape and internal consistency".
